On the 1st of November 1967, the Ambassador Arvid Pardo of Malta addressed the General Assembly of the United Nations and called for “an effective international regime over the seabed and the ocean floor beyond a clearly defined national jurisdiction”. This led to the convening, in 1973, of the Third United Nations Conference on the Law of the Sea. The United Nations Convention on the Law of the Sea entered into force on 16 November 1994. A subsequent Agreement relating to the implementation of Part XI of the Convention was adopted on 28 July 1994 and entered into force on 28 July 1996.This Agreement and Part XI of the Convention are to be interpreted and applied together as a single instrument.

The International Tribunal for the Law of the Sea is an independent judicial body established by the Convention to adjudicate disputes arising out of the interpretation and application of the Convention. The Tribunal is composed of 21 independent members, elected from among persons enjoying the highest reputation for fairness and integrity and of recognized competence in the field of the law of the sea. The jurisdiction of the Tribunal comprises all disputes submitted to it in accordance with the Convention. It also extends to all matters specifically provided for in any other agreement which confers jurisdiction on the Tribunal.

This series is divided into 3 parts:
Part A: This part contains volumes with documents and related materials on the Law of the Sea in general.
Part B: This part contains basic documents on the involvement of the United Nations and the Law of the Sea.
Part C: This part contains the cases brought before the International Tribunal for the Law of the Sea.

For many years the International Atomic Energy Agency (IAEA) assisted Member States, at their request, in developing their domestic legal arrangements for regulating the peaceful uses of nuclear energy and ionizing radiation, as mandated by the IAEA’s Statute. With the expansion of the uses of nuclear techniques in a variety of fields, more States have come to realize that a well structured legal framework is necessary for meeting the technical and management requirements designed to protect public health, safety and the environment. As a result, the IAEA has received an increasing number of requests from Member States for assistance in drafting or reviewing their nuclear laws.For this reason, it was felt that a reference book on nuclear law could be useful in helping legislators, government officials, technical experts, lawyers, diplomats, users of nuclear technology, the media and the public of Member States to understand these requirements.

The primary audience for this book is expected to be persons in States with a less developed nuclear legislative framework who may be involved or interested in the development of a new law covering nuclear activities. A secondary audience would be persons in States interested in revising or consolidating existing laws so as to make them more consistent and efficient, or persons wishing to add legislation in a technical area (or technical areas) in which recent activity has revealed a deficiency in legal arrangements.Also, this book may be of interest to governments that wish to conform their national legislation to international instruments in the nuclear field. Even States with well developed legal structures may find some benefit in using this book as a means of confirming that all necessary legal issues in the nuclear area have been covered, or at least considered, in the framing of their legislation. In addition, it is expected that this book will be useful for teaching nuclear law, at academic institutions and in technical assistance programmes of the IAEA and of other relevant bodies, both international and national.

Even in the middle of the ocean, the law is in action. Legal experts are constantly needed to interpret the laws established by United Nations Convention on the Law of the Sea. Thus, the International Tribunal for the Law of the Sea (ITLOS) was established in 1994 as an independent body in Hamburg, Germany to deal with international maritime disputes. The Convention on the Law of the Sea established a comprehensive legal framework to regulate all ocean space, including its uses and resources. It contains provisions relating to territorial waters, contiguous zones, continental shelves, exclusive economic zones, and the high seas. It also provides for the protection and preservation of the marine environment, for scientific marine research, and for the development and transfer of marine technology. One of the most important parts of the Convention concerns the exploration for and exploitation of the resources of the ocean floor and its subsoil.

The International Tribunal for the Law of the Sea has the important role of the interpretation and application of the above mentioned Convention and its purposes. It has the authority to resolve disputes concerning the law of the sea. Therefore, the International Tribunal for the Law of the Sea has great influence on transboundary international law.

Environmental law is a complex and interlocking body of statutes, common law, treaties, conventions, regulations and policies which, very broadly, operate to regulate the interaction of humanity and the rest of the biophysical or natural environment, toward the purpose of reducing or minimizing the impacts of human activity, both on the natural environment for its own sake, and on humanity itself. De juridische betekenis van de doelstelling van behoud van biologische diversiteit in het Biodiversiteitsverdrag.

Dit boek is het resultaat van een project dat deel uitmaakte van een mede door NWO gefinancierd PIONIER-programma, getiteld ‘The Importance of Ideals in Law, Morality and Politics’, 1996 en 2002 ( Universiteit van Tilburg). Doelstelling van dit interdisciplinaire programma was het voor het voetlicht brengen van de rol die idealen, naast onder meer regels en beginselen, kunnen spelen in theorievorming omtrent recht, moraal en politiek.

Met betrekking tot het behoud van biodiversiteit, dat volgens de binnen het programma gehanteerde omschrijving als ideaal kan worden aangemerkt, werd vooral de vraag interessant gevonden op welke manier een ideaal met een relatief zo korte geschiedenis een rol kan spelen in een vakgebied dat zo zeer in ontwikkeling is als het (internationale) milieu- en natuurbeschermingsrecht. Die vraag heeft dan ook aan de basis gelegen van het nu voorliggende boek. De uiteindelijke uitwerking heeft vooral de vorm gekregen van een zoektocht naar de betekenis die de, zo aansprekende maar zo weinig concrete, doelstelling van biodiversiteitsbehoud kan hebben voor het geldend recht op het gebied van de natuurbescherming. Een stimulans daarbij vormde de constatering dat beschouwingen en commentaren op het Biodiversiteitsverdrag, het belangrijkste document waarin het behoud van biodiversiteit als doelstelling is vastgelegd, over het algemeen ofwel ervan uitgaan dat het verdrag hét logische sluitstuk vormt van de ontwikkeling van het natuurbeschermingsrecht en daarmee een soort allesomvattend kader vormt, ofwel het als betekenisloos terzijde leggen onder verwijzing naar het vage en voorwaardelijke karakter van de bepalingen die erin zijn opgenomen. Een minder oppervlakkige en serieuzere analyse van het verdrag en de daaraan ten grondslag liggende doelstelling van biodiversiteitsbehoud, en van de manier waarop beide kunnen doorwerken in het internationale en nationale recht, ontbrak.

Dit boek is een poging om althans deels in dat gemis te voorzien. Daarbij is dankbaar gebruik gemaakt van het meer rechtstheoretische werk van andere leden van de onderzoeksgroep, in het bijzonder met betrekking tot de rol die beginselen in dit opzicht kunnen spelen.

Op 15 juni 2007 heeft de tweede themadag van het Kenniscentrum Milieu en Openbare Gezondheid van het Gerechtshof ’s-Hertogenbosch plaatsgevonden. Deze dag stond in het teken van dierziekten.

Ten behoeve van deze themadag heeft prof. mr. A.A. Freriks, hoogleraar dier en recht aan de Universiteit Utrecht dit Kennisdocument Dierziekten vervaardigd. In dit tweede document van het Kenniscentrum wordt de rode draad geschetst van de actuele Europese en nationale jurisprudentie op het gebied van dierziekten. Het Kennisdocument Dierziekten kan als naslagwerk dienen voor een ieder die zich in de praktijk met dierziekten bezig houdt.

In de afgelopen tien jaar is Nederland drie keer getroffen door uitbraken van besmettelijke dierziekten: klassieke varkenspest in 1997/1998, mond- en klauwzeer (MKZ) in 2001 en aviaire influenza (AI) in 2003. Meer recent is Nederland voor de eerste keer geconfronteerd met Bluetongue. Deze en andere crises, zoals de BSE-crisis en enkele dioxine-crises, hebben een enorme impact (gehad) op de betrokken productiesectoren, maar ook op het grote publiek. Met name de maatregelen ter bestrijding van dierziekten – waaronder het (preventief) ruimen – hebben vérstrekkende gevolgen en leiden zowel ten tijde van als na een crisis tot een stroom van rechterlijke uitspraken van met name het College van Beroep voor het bedrijfsleven (CBB) en de strafkamers van Rechtbanken en Gerechtshoven.

The environmental governance sphere in South Africa is fragmented. This fragmentation is exacerbated in the provinces. Fragmentation manifests in various ways, including, inter alia, structural fragmentation between the various spheres and line functions of government, fragmented environmental legislation which is silo-based and issue-specific, jurisdictional overlaps, and duplication of procedures and processes. Fragmentation poses several disadvantages and may ultimately hamper effective and sustainable service-delivery by government. The problem of fragmentation forms the crux of this study.

The principal objective of this book is accordingly to investigate possible solutions to address fragmentation and to propose a more sustainable strategy to achieve integration of currently fragmented environmental governance efforts in South Africa and the North-West Province (NWP). The NWP has specifically been chosen as a case study in this regard since problems of fragmentation are exacerbated in the provincesThis study also investigates integrated approaches to environmental governance in the international sphere by way of a comparative study. For this purpose, the relevant provisions of the European Integrated Pollution Prevention and Control Directive, 1996 are discussed.
